THIS MATTER came on for consideration by this Court, without a hearing, on the Trustee's Motion for Authority to Destroy Patient Medical Records (Doc. 366) (the “Motion”). This Court, having reviewed the Motion, being otherwise familiar with the papers and pleadings in this case, having noted that no objections were filed, this Court finds that the Motion should be granted. Accordingly, it is:
ORDERED:
1. The Trustee's Motion is GRANTED as set forth herein.
2. The Trustee is authorized to advertise, in a publication of circulation in at least Hillsborough and Pinellas County, Florida, for 3 consecutive weeks, that patients can request their records prior to September 15, 2021.
3. On September 15, 2021, the Trustee may, after meeting and conferring with Dr. Eric Groteke and Burton Wiand, distribute such of the Debtors' then remaining former patients' Medical Records to either Dr. Eric Groteke or Burton Wiand, as they may agree, so that such individuals may store and preserve such records for their medical and business needs.
4. Following that, the Trustee may destroy the Debtors' then remaining former patients' Medical Records, as described in the Motion without further of this Order.
5. No further notice shall be given once a copy of this Order had been served upon all creditors and other interested parties in these cases and an appropriate Proof of Service is filed and docketed.
