NOTICE IS HEREBY GIVEN that Eric C. Reed, Esq, Shutts & Bowen LLP, 300 S. Orange Ave., Suite 1600, Orlando, FL 32801, as Trustee in the Declaration of Condominium of Clearwater Beach Resort VO Condominium recorded on February 2, 2017 in Official Records Book 19507, Page 176 et seq., public records of Pinellas County, Florida, will sell at public auction to the highest bidder of U.S. funds, in cash or certified funds only, on June 29, 2021 beginning at 9:05 a.m., at the address of 360 Central Avenue, Suite 1500, St. Petersburg, FL 33701, all right, title and interest in the properties as described in Schedule A, located in Pinellas, Florida for continuing nonpayment of the mortgage payments on the described timeshares, as provided for in the Declaration of Vacation Plan for Clearwater Beach Resort Vacation Ownership Plan (“Timeshare Declaration”), as recorded in Official Records Book 19519, Page 2693 et seq., public records of Pinellas County, Florida together with any and all amendments and supplements thereto; and Master Declaration of Condominium of Covenants, Conditions and Restrictions of Clearwater Beach Resort (“Master Declaration”), as recorded on February 2, 2017 in Official Records Book 19507, Page 20 et seq., public records of Pinellas County, Florida.
The trustee foreclosure procedure outlined in Sections 721.856 Florida Statutes was initiated by Wyndham Vacation Resorts, Inc., a Florida corporation, of Pinellas County, Florida, whose address is 6277 Sea Harbor Drive, Orlando, FL 32821 (the “Lienholder”) against the obligors referred to in Schedule A.
The sale will be held pursuant to the obligor(s) failure to pay mortgage payments as set forth in the respective mortgages.
The obligor(s) has/have a right to cure the default and any junior lien holder may redeem its interest up to the date the Trustee issues the Certificate of Sale which shall be issued on the sale date as set forth above, by paying the Assessment Amount with certified funds. Please mail or hand deliver your payment in certified funds (cash, cashier's check, or money order) payable to the “Shutts & Bowen LLP Trust Account” and directed to Trustee, Eric C. Reed, Esq, Shutts & Bowen LLP, 300 S. Orange Ave., Suite 1600, Orlando, FL 32801.
Any person claiming an interest in the surplus from the sales of the properties listed in Schedule A, if any, other than the property owner as of the date of the recording of this Notice, must file a claim within thirty (30) days after the date of this recording.
