YOU ARE HEREBY NOTIFIED of the above styled action by Plaintiffs, ROBIN L. STOVER, DANILO SIMIC and SANDRA HACHMANN-SIMIC, filed against you to declare the existence of the common law implied way of necessity across Defendants' property for the benefit of Plaintiffs' property as to real property located at 805 Higel Drive, Venice, Florida 34285, more particularly described as follows:
BEGIN AT SW CORNER OF LOT 2, BLOCK 5, REPLAT OF PORTION OF GULF VIEW SECTION OF VENICE, RECORDED IN PLAT BOOK 4, PAGE 98, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA; THENCE EAST 585 FEET; THENCE NORTH 116 FEET FOR POINT OF BEGINNING; THENCE CONTINUE NORTH 107 FEET; THENCE EAST 85 FEET; THENCE SOUTH 107 FEET; THENCE WEST 85 FEET TO POINT OF BEGINNING. TOGETHER WITH EASEMENT FOR RIGHT OF WAY OVER A 20 FOOT STRIP OF LAND, THE CENTER LINE OF WHICH IS THE COMMON LINE BETWEEN LOTS 2 & 3, SAID BLOCK 5. (“Plaintiffs' Property”)
including the buildings, appurtenances, and fixtures located thereon, and you are required to serve a copy of your written defenses, if any to it on David S. O'Quinn, Esq., Plaintiffs' attorney whose address is 100 West Cypress Creek Road Suite 889, Fort Lauderdale, Florida 33309, on or before 12-13, 2021, THIRTY (30) DAYS of the first date of publication of this notice in the BUSINESS OBSERVER, Sarasota, Florida, and to file the original with the clerk of this court either before service on Plaintiffs' attorney or immediately thereafter; otherwise a default will be entered against you for the relief demanded in the Complaint filed on October 15, 2021.
