PETITION FOR DISCHARGE
IN THE CIRCUIT COURT
IN AND FOR
PINELLAS COUNTY, FLORIDA PROBATE DIVISION
CASE: 20-2248-GD
IN RE: THE GUARDIANSHIP OF
MAUREEN RENEE HURLEY,
Incapacitated.
Petitioner, FRANCINE JOYCE-MARTIN, as the duly appointed and acting Guardian of MAUREEN RENEE HURLEY, Incapacitated, would show:
1. FRANCINE JOYCE-MARTIN has been appointed as the Guardian of the person and property of the Ward by Letters entered in this cause on July 6, 2020.
2. The Ward has relocated to Pennsylvania pursuant to an Order for Relocation of Ward entered on October 22, 2020.
3. The need for the continuation of this guardianship no longer exists in that FRANCINE JOYCE-MARTIN was appointed as Guardian for MAUREEN HURLEY by a Final Decree issued in the State of Pennsylvania, in the Court of Common Pleas of Delaware County, Pennsylvania, Orphans Court Division, Case No. 39-2021 on June 17, 2021, a copy of which has been filed in this matter.
4. Petitioner represents that all interested persons, if any, have been noticed, have filed receipt of distribution and waiver of notice and consent to discharge of guardian pursuant to Rule 5.670, Florida Rules of Probate and Guardianship Procedure.
5. The Guardian has fully administered the guardianship.
6. The Pennsylvania Guardian and next of kin have filed their Waiver of Final Accounting and Consent to the Discharge of Guardian, a copy of which has been provided to the Ward, and the Pennsylvania guardian's Counsel in this cause.
7. A petition for Final Attorney Fees has been filed in this cause and a petition for Final ETG Fees has been filed for which a hearing is scheduled on September 24, 2021. There are no other known unpaid or anticipated costs and fees to be paid to the guardian, attorney or other agents employed by the guardian.
8. There is no further need to continue this guardianship.
WHEREFORE, Petitioner requests that an Order be entered approving all accountings not previously approved and discharging petitioner as guardian and releasing the surety on Petitioners' bond, if any, from further liability.
Under penalties of perjury, I declare that I have read the foregoing and the facts alleged are true, to the best of my knowledge and belief.
WHEREFORE, in that the Guardianship has been accepted in Pennsylvania and that the Ward's next-of-kin, FRANCINE JOYCE-MARTIN has been appointed as Guardian for MAUREEN RENEE HURLEY, the Petitioner respectfully prays that this Honorable Court enter an Order Discharging FRANCINE JOYCE-MARTIN, as Guardian of MAUREEN RENEE HURLEY, Incapacitated, in the Circuit Court of Pinellas County, Florida, and releasing the surety on Petitioner's bond, if any, from any and all further liability.
