NOTICE OF RULE DEVELOPMENT BY HARBOR BAY COMMUNITY DEVELOPMENT DISTRICT
In connection with its ownership and operation of certain rights-of-way, including street trees and improvements located thereon (hereinafter collectively referred to as the “District Property”) and in accordance with Chapters 120 and 190, Florida Statutes, the Harbor Bay Community Development District (the “District”) hereby gives notice of its intention to amend rules governing the use of District Property and removal and replacement of street trees located on District rights-of-way, including but not limited to amending the fees for removal and replacement of District-owned street trees with the express, written permission from the District.
The proposed amendment to the rules will address, among other things: the use of District Property and removal and replacement of street trees located on District rights-of-way, including but not limited to fees for removal and replacement of District-owned street trees with the express, written permission from the District.
The purpose and effect of these rules and policies is to establish procedures and requirements to protect District Property. Specific legal authority for the rules includes Sections 190.011, 190.012, 190.035, 120.54, and 120.81, Florida Statutes (2020).
A public hearing on the adoption of the proposed rule amendment will be conducted by the District on October 21, 2021, at 6:00 p.m. at 107 Manns Harbor Drive, Apollo Beach, Florida 33572.
