NOTICE OF RULEMAKING BY HARBOR BAY COMMUNITY DEVELOPMENT DISTRICT
In connection with its ownership and operation of certain rights-of-way, including street trees and improvements located thereon (hereinafter collectively referred to as the “District Property”) and in accordance with Chapters 120 and 190, Florida Statutes, the Harbor Bay Community Development District (the “District”) hereby gives notice of its intention to amend its rules governing the use of District Property and removal and replacement of street trees located on District rights-of-way, including but not limited to fees for removal and replacement of District-owned street trees with the express, written permission from the District.
The proposed amendment is to change the “License Fee for Removal and Replacement by Resident under a License Agreement” from $100 per tree to $100 per request/license. The intent of this change is to reduce costs for residents seeking to remove and replace street trees owned by the District.
A public hearing on the adoption of the proposed rules will be conducted by the District on October 21, 2021, at 6:00 pm at 107 Manns Harbor Drive, Apollo Beach, Florida 33572.
The proposed, amended fees may be adjusted at the public hearing after discussion by the Board of Supervisors and public comment. The purpose and effect of the proposed rules are to protect District Property.
Prior Notice of Rule Development was published in the Business Observer on September 10, 2021.
Legal authority for the proposed rules includes Chapter 190, Florida Statutes, generally, and Sections 190.011(5), 190.012(3), 190.035, 190.041, 120.54 and 120.81, Florida Statutes, specifically.
Any person who wishes to provide the District with a proposal for a lower cost regulatory alternative as provided by Section 120.541(1), Florida Statutes, must do so in writing within twenty-one (21) days after publication of this notice.
This public hearing may be continued to a date, time, and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at the hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made which includes the testimony and evidence upon which such appeal is to be based. At the hearing, one or more Supervisors may participate in the public hearing by telephone. Any person requiring special accommodations at the hearing because of a disability or physical impairment should contact the District Office at 321-263-0132 at least forty-eight (48) hours prior to such hearing.
