JOHN S. FRANZONE, INDIVIDUALLY AND AS TRUSTEE OF THE JOHN S. FRANZONE GRANTOR REVOCABLE TRUST U/A/D MARCH 13, 2003, et al.,

Notice is hereby given pursuant to a Final Judgment of foreclosure filed the day 13 of day of September, 2021, and entered in case No. 21-CC-003106 in the County Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein BAYPOINTE YACHT & RACQUET CLUB CONDOMINIUM ASSOCIATION, INC. is the Plaintiff and JOHN S. FRANZONE, INDIVIDUALLY AND AS TRUSTEE OF THE JOHN S. FRANZONE GRANTOR REVOCABLE TRUST U/A/D MARCH 13, 2003 is the Defendant. That I will sell to the highest and best bidder for cash beginning at 9:00 AM at www.lee.realforeclose.com in accordance with Chapter 45, Florida Statutes, on the day of OCTOBER 13, 2021, the following described property as set forth in said Final Summary Judgment of Foreclosure, to-wit:
Unit No. B-101, BAYPOINTE YACHT AND RACQUET CLUB CONDOMINIUM, PHASE I, a Condominium according to the Declaration of Condominium of Baypointe Yacht and Racquet Club Condominium, as recorded in O.R. Book 1745, Pages 2221 through 2307, inclusive, of the Public Records of Lee County, Florida, together with an undivided interest in and to the common elements as the same are established and identified in the Declaration of Condominium and plans on file in the official records of Lee County, Florida. The unit and undivided ownership in the common elements and limited common elements are conveyed subject to the provision of Chapter 718, Florida Statutes, the Declaration of Condominium of Baypointe Yacht and Racquet Club Condominium, and its By-Laws and the lien of real property taxes due for the current and subsequent years.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim in accordance with Florida Statutes, Section 45.031 before the Clerk reports the surplus as unclaimed.
