This is an Invitation to Bid to select a Contractor(s) to close the Old Gyp Stack - South within the Piney Point Phosphates Phosphogypsum Stack System. The Contractor(s) shall provide these services for Herbert R. Donica, the Court Appointed Receiver, for the property on a lump sum or a time and materials not-to-exceed basis.

Donica Receivership Services, LLC requests Bids from responsible vendors with demonstrable experience in phosphogypsum stack closure construction to meet its upcoming needs. A brief description of the procurement is provided for Bidders' convenience; detailed information and requirements will be included in the Bid Package. Brief Description:
The Piney Point Phosphogypsum Stack System (the “Stack System”) is located in Manatee County, Florida. The Stack System currently has four partially closed phosphogypsum compartments. Phosphogypsum is a byproduct of fertilizer production. On August 25, 2021, the Manatee Circuit Court entered an order appointing Herbert R. Donica as a Receiver to take control of the Stack System and oversee its final closure. The purpose of the Receivership is to remove the pond water inventory, maintain, repair, and permanently close the Stack System so that it is no longer a threat to public safety and the environment. This procurement is for the closure of one of the four former phosphogypsum stack compartments, the Old Gyp Stack - South (the “OGS-S”). The OGS-S has an area of approximately 24 acres and does not currently hold standing water, except any accumulated rainfall. The OGS-S compartment was partially closed (i.e., lined with HDPE liner) and used to store marine sediments generated by the dredge operations, and does not contain phosphate industry related process water.
The permanent closure of the OGS-S compartment will involve the following main tasks but not limited to:
(i) installation of a high-strength woven geotextile over a portion of the pond that has soft marine sediments (approximately 14 acres);
(ii) placement of a layer of clean sand (to be provided by the Receiver), approximately 3 to 6 feet in thickness, to act as a surcharge and to provide a stable base for light construction equipment traffic;
(iii) installation of a consolidation water collection drain system within the sand layer;
(iv) installation of a gas venting system on top of the sand layer;
(v) placement of a sand or gypsum layer (approximately 1 foot thick) on top of the10-acre area of the compartment that is filled with coarse dredge materials;
(vi) installation of a 60-mil high-density polyethylene (HDPE) geomembrane (i.e., liner) over the entire pond;
(vii) placement of a minimum of 24” of compacted clean soil cover (to be provided by the Receiver) on top of the HDPE Liner;
(viii) installation of a stormwater control system (comprised of a sand drain, a control structure and a broad-crested weir with erosion protection cut in the gypsum perimeter dike);
(ix) Pipe penetrations through the existing gypsum perimeter dike for the drain and stormwater system to discharge water outside of the pond;
(x) grassing, and;
(xi) any other related tasks as shown in the design Drawings and Engineering Specifications to support complete closure of the OGS-S pond to meet the Florida Department of Environmental Protection's approved Conceptual Closure Plan and the closure requirements of Rule 62-673, Fla. Admin. Code.
Projected starting and ending dates will be disclosed in the Bid Package.
Please read the entire Bid Package and submit a Bid for evaluation in accordance with the instructions. All forms and signature areas contained in the Bid Package must be completed in full and submitted along with the proposal, which will constitute the Bid. Inexperienced Contractors and Bids that do not conform to the Bid Package forms and bid requirements may not be considered.

The Receiver reserves the right to reject any and all Bids, to waive irregularities, if any, and accept the Bid, which in the judgment of the Receiver, is determined to be in its best interest.
