Lesser Financial Enterprises, LLC v. S/V LA SONATA
By virtue of an Order granting final default judgment and ordering the sale of the vessel S/V LA SONATA dated November 28, 2022 and issued from the United States District Court for the Middle District of Florida, notice is hereby given that I will sell by public auction for cashier's or certified check, on January 9, 2023 at 11:00am, on the steps of the U.S. Federal Building Courthouse at 2110 First St, Fort Myers, FL 33901, the following vessel:
S/V LA SONATA, a 2005 49-foot Jeanneau bearing Hull Identification Number IRI00035B505 and U.S. Coast Guard Official Number 1176551, her engines, tackle, furniture, tenders, apparel, and appurtenances
The successful bidder shall be required to pay a deposit to the U.S. Marshal of ten percent (10%) of the sale's price at the time and place of sale. Thereafter, the successful bidder shall pay the remainder of the bid within seven (7) days unless objections to the sale are filed. All payments shall be in certified or cashier's check drawn upon a first class commercial bank with an office or branch within the Middle District of Florida. Failure to pay the balance in accordance with the terms of the sale shall result in the forfeiture of the monies deposited and the vessel will be re-offered for sale. The sale of the vessel shall be “AS IS, WHERE IS” and free and clear of all liens and encumbrances, and pre-existing claims on the vessel, whether recorded or otherwise. The sale shall comply with all laws of the U.S.A., including the citizenship requirements of Section 2 of the Shipping Act of 1916 as amended. The Court shall confirm the sale or sustain objections in conformance with Local Admiralty Rules.
Pursuant to the Court's Order, Plaintiff Lesser Financial Enterprises, LLC is permitted to credit bid using its Default Judgment, or any part thereof, in lieu of cash and shall not be required to pay cash or other payment, either as a deposit at the time or as a balance of the purchase price. The Default Judgment is $197,289.64 in damages for the unpaid balance of its loan, including late fees and interest, $3,949.49 in storage charges, $500.00 in administrative fees, and $605.81 in custodia legis expenses as of September 23, 2022, and pre-judgment interest as provided by federal law.
