NOTICE OF PROPOSED AMENDMENT TO THE TOWN CENTER AT PALM COAST PLANNED UNIT DEVELOPMENT (PUD) -
DEVELOPMENT AGREEMENT (DA)
CITY COUNCIL PUBLIC HEARING
The City of Palm Coast City Council will consider Ordinance No. 2022-XX Entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM COAST, FLORIDA, APPROVING THE FIRST AMENDED AND RESTATED DEVELOPMENT AGREEMENT FOR THE TOWN CENTER AT PALM COAST MASTER PLANNED DEVELOPMENT (MPD); CLARIFYING THAT TOWN CENTER ARCHITECTURAL REVIEW BOARD REVIEW AND APPROVE DESIGN OF PROJECTS; AMENDING DESIGNATION OF TRACTS 16 & 17 FROM TOWN BUSINESS TO TOWN RESIDENTIAL; CLARIFYING TRACTS IN TOWN BUSINESS AREAS PERMIT INSTITUTIONAL USES; PERMITTING CERTAIN COMMERCIAL SERVICE USES IN TOWN CORE AREA, INCLUDING HOSPITALS, AND DEFINING AND PERMITTING STUDENT HOUSING; REDUCING MINIMUM LOT SIZES IN TOWN CORE AND TOWN RESIDENTIAL AREAS; ESTABLISHING MINIMUM LIVING AREAS FOR RESIDENTIAL USES; CLARIFYING RULES FOR CONSTRUCTION FENCES; AMENDING PARKING REQUIREMENTS FOR MULTI-FAMILY DEVELOPMENT ON CERTAIN PARCELS; REGULATING OVERNIGHT PARKING; AND UPDATING AND COMBINING CERTAIN EXHIBITS TO REFLECT TEXT CHANGES TO THE MPD; PROVIDING FOR LEGISLATIVE FINDINGS AND INTENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE
This is a request by the Declarant, Florida Landmark Communities, LLC to amend the Town Center at Palm Coast PUD-DA. The amendment is intended to clarify existing language in the PUD-DA regarding design review of projects, construction fences, the permitted uses within the Town Business Area of the PUD. The amendment will change the designation of Tracts 16 & 17 from Town Business to Town Residential. The amendment further includes language to permit personal services and uses in the Town Core area of the PUD, hospitals, and student housing within certain tracts in the PUD. The amendment also includes amending minimum lot sizes in the Town Core and Town Residential Areas of the PUD as well as establishing minimum dwelling unit sizes within the PUD. The amendment will include amending parking requirements for multi-family uses on certain parcels, rules for overnight parking as well as the updating of certain map exhibits to reflect the text changes to the PUD-DA. The subject property is located as depicted in the Location Map provided below.
The City Council will hold a public hearing on the proposed PUD-Development Agreement Amendment, on July 5, 2022 at 6:00 p.m., or as soon thereafter as possible, in the Community Wing of City of Palm Coast City Hall located at 160 Lake Ave., Palm Coast, Florida.
A copy of this notice and the file relating to the public hearing are available by contacting the City Clerk at 386-986-3713. The public is encouraged to participate in the processes and procedures of the City.
Members of the public who wish to submit comments, exhibits, or other documents for consideration at the Public Hearing may submit them to the following: [email protected]. The e-mail should indicate that they are intended for public participation and may be submitted up until 5 pm the day before the meeting. The City reserves the right to redact or reject Documentary Evidence containing obscene material or material that is confidential pursuant to state law.
If a person decides to appeal any decision made with respect to any matter considered at the above referenced hearing, he/she will need a record of the proceedings. For such purposes, it may be necessary to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
