Take notice that a pleading seeking relief against you has been filed in the above-entitled action. The nature of the relief being sought is as follows: That the Defendants have violated the Declaration of Restrictive Covenants for South Mountain Peaks recorded in Deed Book 891, page 297 of the Rutherford County, North Carolian Register of Deeds Office, as amended (“Declaration”) by not bringing Lot 28B of South Mountain Peaks (“Defendants' Property) in to compliance with the Declaration and by not paying assessments fined as result of the violations and the Plaintiff requests that the Court award damages against Defendants for unpaid assessments and that the Court render judgment by judicial sale in accordance with N.C.G.S. 47F-3-116 and that the Court award attorney's fees to the Plaintiff in accordance with N.C.G.S. 47F-3-116.
You are required to make a defense to such pleading no later than May 6, 2022 and upon your failure to do so, the party seeking service against you will apply to the Court for the relief sought.
