YOU ARE HEREBY NOTIFIED of an action for non judicial foreclosure of timeshare units and weeks listed in the Amended Claim of Lien filed and recorded for THE PENTHOUSES AT GULF STREAM RESORT CONDOMINIUM ASSOCIATION, INC. on April 14, 2022, Instrument Number 202241050374, of the Public Records of Manatee County, Florida. Unit 401, Week 31 and Unit 403, Week 34, respectively, are for the following described real property located in MANATEE COUNTY, STATE OF FLORIDA:
A Flexible Vacation Interest in Unit , Vacation Week Number of THE PENTHOUSES AT GULF STREAM Resort, a condominium, according to Amended and Restated Declaration of Condominium thereof recorded in Official Records Book 1624, Page 2053 and subsequent pages of the Public Records of Manatee County, Florida and all amendments thereof, which condominium is also described in Condominium Plat Book 29, Pages 146-148, Public Records of Manatee County, as Amended. If the interest conveyed is a Biennial Vacation Interest, it is an N/A interest, and the recurring exclusive right of possession and occupancy occurs in calendar years ending in N/A numbers.
The assessment lien created by the Amended Claim of Lien was properly created and authorized, pursuant to the timeshare instrument and applicable law, and the amounts secured by said lien is as set forth on attached Exhibit “A” along with the per diem interest. You may cure the default at any time prior to the issuance of the Certificate of Sale by paying the amount due to the undersigned Trustee at the address set forth below, within thirty (30) days of first publication date of this Notice of Publication.

If you fail to cure the default as set forth in this notice or take other appropriate action with regard to this foreclosure matter, you risk losing ownership of your timeshare interest through the trustee foreclosure procedure established in§ 721.855, Florida Statutes. You may choose to sign and send to the trustee an objection form exercising your right to object to the use of the trustee foreclosure procedure by calling or writing the trustee set forth below for a copy of the objection form. Upon the trustee's receipt of your signed objection form, the foreclosure of the lien with respect to the default specified in this action shall be subject to the judicial foreclosure procedure only. You have the right to cure your default in the manner set forth in this notice at any time before the trustee's sale of your timeshare interest. If you do not object to the use of the trustee foreclosure procedure, you will not be subject to a deficiency judgment even if the proceeds from the sale of your timeshare interest are insufficient to offset the amounts secured by the lien.
You are required to object in writing. Objections are to be mailed to the trustee, Theresa A. Deeb, Esquire, at 6677 13th, Avenue North, Suite 3A, St. Petersburg, FL 33710 within thirty (30) days of the first publication date of this Notice of Action.
