NOTICE OF RULEMAKING FOR AMENDED AMENITY POLICIES AND RATES BY THE SOLTERRA RESORT COMMUNITY DEVELOPMENT DISTRICT
A public hearing will be conducted by the Board of Supervisors (“Board”) of the Solterra Resort Community Development District (the “District”) on October 27, 2022 at 9:30 a.m. at the Solterra Resort Clubhouse, 5200 Solterra Boulevard, Davenport, Florida 33837.
In accordance with Chapters 190 and 120, Florida Statutes, the District hereby gives the public notice of its intent to adopt amended proposed rules related to the use of the District's amenity facilities. The public hearing will provide an opportunity for the public to address proposed rules that: (1) establish lazy river policies and rules; and (2) amend the rental deposit and amenity rental procedures and fees; and (3) update administrative provisions.
The proposed revisions, including rates, may be adjusted at the public hearing pursuant to discussion by the Board of Supervisors and public comment. The purpose and effect of the Amended Amenity Facilities Rules and Policies is to provide for efficient District operations by setting policies, regulations, rates and fees to implement the provisions of Section 190.035, Florida Statutes (2021). Specific legal authority for the rule includes Sections 190.035(2), 190.011(5) and 120.54, Florida Statutes. Prior Notice of Rule Development was published in the Business Observer on September 16, 2022.
Any person who wishes to provide the District with a proposal for a lower cost regulatory alternative as provided by Section 120.541(1), Florida Statutes, must do so in writing within twenty-one (21) days after publication of this notice.
The public hearing to be held at the date, time and location stated above may be continued to a date, time and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at the public hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made which includes the testimony and evidence upon which such appeal is to be based.
