Notice is hereby given pursuant to a Final Summary Judgment of Foreclosure filed the 20th day of April, 2023, and entered in Case No. 22-CC-3060 in the County Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein BAYPOINTE YACHT & RACQUET CLUB CONDOMINIUM ASSOCIATION, INC. is the Plaintiff and CHERYL MARSCHALL, IF LIVING AND IF DEAD, THE UNKNOWN HEIRS, DEVISEES, GRANTEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHER PARTIES CLAIMING AN INTEREST BY, THROUGH, UNDER, OR AGAINST CHERYL MARSCHALL, THE UNKNOWN SPOUSE OF CHERYL MARSCHALL, MISTY A. MINNICK and TYRONE W. ROGERS are the Defendants. That I will sell to the highest and best bidder for cash beginning at 9:00 AM at www.lee.realforeclose.com in accordance with Chapter 45, Florida Statutes, on MAY 25, 2023 the following described property as set forth in said Final Summary Judgment of Foreclosure, to-wit:
Unit No. B-107, BAYPOINTE YACHT AND RACQUET CLUB CONDOMINIUM, PHASE II, a Condominium according to the Declaration of Condominium thereof recorded in Official Records Book 1745, Pages 2221 through 2307, inclusive, of the Public Records of Lee County, Florida, and all amendments thereto, together with an undivided interest in the common elements
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim in accordance with Florida Statutes, Section 45.031 before the Clerk reports the surplus as unclaimed.
