NOTICE IS HEREBY GIVEN pursuant to the Final Judgment and/or Order Rescheduling Foreclosure Sale, entered in Case No. 2019CA000951000000 of the Circuit Court of the TENTH Judicial Circuit, in and for Polk County, Florida, wherein Deutsche Bank National Trust Company, as Trustee for Ameriquest Mortgage Securities Inc., Asset-Backed Pass-Through Certificates, Series 2006-R2 is the Plaintiff and Eric D. Tucker a/k/a Eric Tucker a/k/a Eric Daniel Tucker; Unknown Spouse of Eric D. Tucker a/k/a Eric Tucker a/k/a Eric Daniel Tucker; Jennifer Allena Tucker a/k/a Jennifer A. Tucker a/k/a Jennifer Tucker; State of Florida Department of Revenue; Lake Wales Hospital Corporation d/b/a Lake Wales Medical Center; Clerk of the Court, Polk County, Florida are the Defendants, that Stacy M. Butterfield, Polk County Clerk of Court will sell to the highest and best bidder for cash at, www.polk.realforeclose.com, beginning at 10:00 AM on the 12th day of September, 2023, the following described property as set forth in said Final Judgment, to wit:
THE WEST 75.3 FEET OF THE EAST 100.3 FEET OF THE SOUTH 143.6 FEET OF THE NORTH 168.6 FEET OF THE NORTHWEST 1/4 OF THE SOUTHEAST 1/4 OF THE SOUTHEAST 1/4 OF SECTION 32, TOWNSHIP 31 SOUTH, RANGE 28 EAST ALSO KNOWN AS PART OF LOT 1, BLOCK B OF FLOOD & CARSON'S ADDITION TO FROSTPROOF, FLORIDA, RECORDED IN PLAT BOOK 1, PAGE 54 PUBLIC RECORDS OF POLK COUNTY, FLORIDA TOGETHER WITH:
THE EAST 25 FEET OF THE SOUTH 143.6 FEET OF THE NORTH 168.6 FEET OF THE NORTHWEST 1/4 OF THE SOUTHEAST 1/4 OF THE SOUTHEAST 1/4 OF SECTION 32, TOWNSHIP 31 SOUTH, RANGE 28 EAST, BEING PART OF SAID LOT 1, BLOCK B, A PORTION OF WHICH LIES WITHIN THE LIMITS OF THE RIGHT-OF-WAY FOR PEACHTREE AVENUE CLOSED BY ORDINANCE NUMBER 394. SUBJECT TO PERMANENT EASEMENT FOR EGRESS & INGRESS FOR THE MAINTENANCE OF CITY OWNED UTILITIES LOCATED THEREON IN THAT PORTION OF THE CLOSED PEACHTREE AVENUE.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim before the clerk reports the surplus as unclaimed.
