Petitioner/Mother, Flor Victoria Juarez, being sworn, petitions this court for termination of parental rights of the Biological Father of the minor child, and states as follows:
1. This is an action under Fla.Stat. 39.806(1). The grounds for the termination of parental rights may be established under any of the following circumstances. Section (b) abandonment as defined in s.39.01 (1) or when the identity or location of the parent of parents is unknown and cannot be ascertained by diligent search within 60 days.
2. The minor child (ren) subject to this petition is/are:
Miguel Manolo Martinez
D.O.B.: March 29th, 2019
A certified copy of the birth certificate of the minor child will be attached.
3. The minor child has not used any other names.
4. A completed Uniform Child Custody Jurisdiction Affidavit (UCCJA), Florida Supreme Court Approved Family Law Form 12.902(d), will be filed with this petition.
5. The grounds for terminating parental rights are:
a. The father has abandoned the child and the mother for over 1 year.
b. The Petitioner/Mother has sole custody and complete responsibility for taking care of the minor child.
c. It will be in the best interest of the minor child, to be under the custody of his biological mother without the possibility of the father returning and upsetting the happy family dynamic.
WHEREFORE, I request that this Court enter a Final Judgment of Termination of Parental Rights Pending of the Father in the above styled matter.
I understand that I am swearing or affirming under oath to the truthfulness of the claims made in this consent and waiver and that the punishment for knowingly making a false statement includes fines and/or imprisonment.
