NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated November 19, 2020, and entered in 2017 CA 004508 NC of the Circuit Court of the TWELFTH Judicial Circuit in and for Sarasota County, Florida, wherein DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR GSAMP TRUST 2005-HE4 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-HE4 is the Plaintiff and KATHEY SCHMANSKI; IBERIABANK SUCCESSOR IN INTEREST TO CENTURY BANK, FSB; ULRICH, SCARLETT, WICKMAN & DEAN, PA F/K/A JUDD, ULRICH, SCARLETT, WICKMAN & DEAN, PA F/K/A JUDD, ULRICH, SCARLETT, SUMMONTE & DEAN, P.A.; CAPITAL ONE BANK (USA), N.A. are the Defendant(s). Karen Rushing as the Clerk of the Circuit Court will sell to the highest and best bidder for cash at www.sarasota.realforeclose.com, at 09:00 AM, on March 14, 2023, the following described property as set forth in said Final Judgment, to wit:
A PORTION OF LOT 12, SARASOTA BY THE SEA SUBDIVISION, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 6, PAGE 21, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE SOUTHWESTERLY MOST 66.00 FEET OF SAID LOT 12, SARASOTA BY THE SEA SUBDIVISION.
TOGETHER WITH A 12.00 FOOT WIDE EASEMENT FOR UNDERGROUND UTILITIES AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOW: THE NORTHWESTERLY MOST 12 FEET OF THE NORTHEASTERLY MOST 84.00 FEET OF SAID LOT 12, SARASOTA BY THE SEA SUBDIVISION.
TOGETHER WITH THE RIGHT, EASEMENT AND PRIVILEGE IN FAVOR OF THE GRANTEE, THEIR HEIRS, LICENSEES, TENANTS AND ASSIGNS, TO USE IN COMMON WITH THE OWNER OF THE REMAINING LOTS INCLUDED IN THE SUBDIVISION OF SARASOTA BY THE SEA, THE SAME IS RECORDED IN PLAT BOOK 6, PAGE 21, PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, THE ROADWAY DESCRIBED ON SAID PLAT OF SARASOTA DRIVE AND THE EXTENSION THEREOF IN A SOUTHWESTERLY DIRECTION 30 FEET IN WIDTH AS SHOWN ON SAID PLAT AS ACCESS TO PEDESTRIANS TO A BEACH ON THE GULF OF MEXICO, AND TO USE IN COMMON WITH OTHERS THE BEACH ADJOINING SAID SUBDIVISION.
THE GRANTOR HEREIN DOES GRANT TO THE GRANTEES, THEIR SUCCESSORS AND ASSIGNS A NON-EXCLUSIVE PERPETUAL EASEMENT TO RUN WITH THE LAND FOR INGRESS AND EGRESS OVER GRANTEE'S REAL PROPERTY DESCRIBED AS FOLLOWS:
A PORTION OF LOT 12, SARASOTA BY THE SEA SUBDIVISION, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 6, PAGE 21, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE NORTHEASTERLY MOST 84.00 FEET OF SAID LOT 12, SARASOTA BY THE SEA SUBDIVISION. SAID EASEMENT IS OVER THE NORTHEASTERLY 6.7 FEET OF THE CURRENTLY EXISTING 14 FEET WIDE DRIVEWAY FROM SARASOTA CIRCLE TO GRANTEE'S REAL PROPERTY AND LYING ON THE SOUTHEASTERLY 6.7 FEET OF GRANTORS REAL PROPERTY.
