NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 21st day of December 2022, and entered in Case No. 2022-CA-003781-O, of the Circuit Court of the 9TH Judicial Circuit in and for ORANGE County, Florida, wherein TOWD POINT MORTGAGE TRUST 2017-4, U.S. BANK NATIONAL ASSOCIATION, AS INDENTURE TRUSTEE is the Plaintiff and UNKNOWN HEIRS, BENEFICIARIES, DEVISEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN THE ESTATE OF RICHARD ACTON BANK OF AMERICA, N.A. COCO PLUM VILLAS CONDOMINIUM ASSOCIATION, INC MICHAEL RICHARD ACTON JAMES MANUEL BELLAGIO; and MARY CATHERINE BRAZIL ACTON IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 7th day of March 2023 at 11:00 AM at www.myorangeclerk.realforeclose.com. TIFFANY MOORE RUSSELL as the Orange County Clerk of the Circuit Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT B-6, COCO PLUM VILLAS, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF RECORDED IN OFFICIAL RECORD BOOK 8703, PAGE 2916, AS AMENDED FROM TIME TO TIME, OF THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN THE DATE THAT THE CLERK REPORTS THE FUNDS AS UNCLAIMED. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER THE FUNDS ARE REPORTED AS UNCLAIMED, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
