YOU ARE HEREBY NOTIFIED that an action has been filed against you in the Circuit Court of Charlotte County, Florida, raising two counts. The first count is for violation of Fla. Stat. ยง 817.535 for filing false, fictitious, or fraudulent UCC Financing Statements in the Public Records of Charlotte County, Florida. The second count seeks a declaratory judgment declaring that the false, fictitious or fraudulent UCC Financing Statements are null and void and seeking to expunge them from the Public Records of Charlotte County. The false, fictitious, or fraudulent UCC Financing statements relate to the following real property together with all existing or subsequently erected or affixed buildings, improvements, and fixtures, situated, lying, and being in Charlotte County, Florida, and more particularly described as:
LOTS 3, 24 AND 25, BLOCK 799, PORT CHARLOTTE SUBDIVISION SECTION TWENTY SIX, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 5, PAGES 19A THROUGH 19E, OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
And having a street address of: 20995 Lawson Ave, Port Charlotte, FL 33952
You are required to file your written defenses, if any, to it with the Clerk of the above-styled Court and to serve a copy thereof on Daniel Cardenal, Esq., plaintiff's attorney, whose address is Akerman LLP, Three Brickell City Centre, 98 Southeast 7th Street, Suite 1100, Miami, Florida 33131, within thirty (30) days from the first date of publication of this Notice of Action.
If you fail to do so, Judgment by default may be entered against you for the relief demanded in the Complaint.
