NOTICE OF RULEMAKING BY VILLAGES OF BLOOMINGDALE COMMUNITY DEVELOPMENT DISTRICT REGARDING AN AMENDMENT TO THE VILLAGES OF BLOOMINGDALE COMMUNITY DEVELOPMENT DISTRICT AMENITY CENTER POLICIES, SUSPENSION AND TERMINATION OF ACCESS RULES
A public hearing will be conducted by the Board of Supervisors of the Villages of Bloomingdale Community Development District (the “District”) on August 15, 2023, at 9:00 a. m., at 6301 Valleydale Drive, Riverview, Florida, 33578.
In accordance with Chapters 190 and 120, Florida Statutes, the District hereby gives the public notice of its intent to adopt an amendment to The Villages of Bloomingdale Community Development District Amenity Center Policies, Suspension and Termination of Access Rule (“Suspension and Termination Rules”), last revised, approved, and effective February 21, 2023, related to the use of the District's recreational facilities.
The Amendment recognizes that the purpose and effect of the Suspension and Termination Rules are to provide for efficient and effective District operations of the District's amenity facilities and other properties by setting policies and regulations to implement the provisions of Section 190.035, Florida Statutes. To further the purpose and effect of the Suspension and Termination Rules, the Amendment would allow the District to restrict, suspend, or terminate the amenity facility access privileges of a property owner for the conduct of a tenant.
Specific legal authority for the rule includes Sections 190.035(2), 190.011(5) and 120.54, Florida Statutes. Prior Notice of Rule Development was published on July 7, 2023.
Any person who wishes to provide the District with a proposal for a lower cost regulatory alternative as provided by Section 120.541(1), Florida Statutes, must do so in writing within twenty-one (21) days after publication of this notice.
The public hearing may be continued to a date, time, and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at the public hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made which includes the testimony and evidence upon which such appeal is to be based.
