NOTICE OF RULEMAKING REGARDING THE RULES RELATING TO STREET PARKING AND PARKING ENFORCEMENT OF THE WATERLEAF COMMUNITY DEVELOPMENT DISTRICT
A public hearing will be conducted by the Board of Supervisors of the Waterleaf Community Development District (the “District”) on Monday, December 11, 2023 at 5:30 p.m. at Bloomingdale Regional Public Library, 1906 Bloomingdale Ave, Valrico, FL 33596. In accordance with Chapters 120 and 190, Florida Statutes, the District hereby gives notice of its intent to adopt proposed Rules Relating to Street Parking and Enforcement (“the Rules”). The purpose and effect of the proposed Rules are to provide for proper and efficient operation of District streets and to maintain compliance with applicable law. The Rules may address the following relating to parking on District streets: (i) hours when on-street parking is permitted; (ii) locations where on-street parking is prohibited; (iii) prohibition on overnight street parking and (iv) providing towing/removal procedures. At the conclusion of the hearing, the Board shall, by resolution, adopt the proposed Rules as finally approved by the Board of Supervisors. Prior notice of rule development was published in Business Observer (Hillsborough) on November 3, 2023.
Specific legal authority for the proposed Rules and the adoption of the proposed Rules includes, without limitation, Sections 120.54, 190.011(5), 190.011(15), 190.012, and 715.07 Florida Statutes. The specific laws implemented in the proposed Rules include, without limitation, Sections 190.011(5), 190.012(2), 190.012(3), 190.041, and 715.07 Florida Statutes.
Any person who wished to provide the District with a proposal for a lower cost regulatory alternative as provided by Section 120.541(1), Florida Statutes, must do so in writing within twenty-one (21) days after publication of this notice to the District Manager at Vesta Property Services, 250 International Parkway, Suite 208, Lake Mary, Florida 32746.
The public hearing may be continued to a date, time and place to be specified on the record at the hearing. Each person who decides to appeal any decision made by the Board with respect to any matter considered at the public hearing and meeting is advised that person will need a record of the proceedings and that accordingly, the person may need to ensure that a verbatim record of the proceedings is made, including the testimony and evidence upon which such appeal is to be based.
At the public hearing, one or more Supervisors may participate in the public telephone or other electronic means. At the above location, if a public hearing is requested, there will be present a speaker so that any interested party can physically attend the public hearing at the above location and be fully informed of the discussions taking place either in person or by speaker device.
