as described in Official Record Book 4395, Pages 1893, of the Public Records of Pasco County, Florida, being a portion of the Southeast 1/4 of Section 35, Township 25 South, Range 22 East, Pasco County, Florida, being more particularly described as follows:
Commence at the intersection of the South line of Lot 350, UNRECORDED PLAT OF COMMERCIAL HIGHLANDS SOUTH as recorded in Official Records Book 4395, Page 1893 of the Public Records of Pasco County, Florida, and the existing North right of way line of County Road 54 per Florida Department of Transportation Right of Way Map Sections 14090-2501 & 16001-2501, said right of way line also being the South line of said Lot 350 said intersection being marked by a 1/2” Capped Iron Rod stamped “SURVEYS INC LB 3028”, lying S 57°42'50” E, 0.94 feet from said intersection; thence S 89°59'32” E, along said North right of way line and said South line, a distance of 325.81 feet to the POINT OF BEGINNING and a point on a curve concave Northwesterly, having a radius of 179.50 feet; thence Northeasterly 72.71 feet along the arc of said curve, having a central angle of 23°12'33”, and a chord bearing and distance of N 78°24'11” E, 72.22 feet to the point of compound curvature of a curve concave Northwesterly, having a radius of 41.00 feet; thence Northeasterly 66.65 feet along the arc of said curve, having a central angle of 93°08'25”, and a chord bearing and distance of N 20°13' 42” E, 59.55 feet; thence non-tangent, N 57°43'07” W, a distance of 326.91 feet to the West line of said Lot 350; thence N 32°17'01” E, along said West line, a distance of 18.00 feet to the existing Southerly right of way line of State Road 700 / State Road 35 (U.S. 98) per Florida State Road Department Right of Way Map Section 1407-201, said right of way line also being the North line of said Lot 350; thence S 57°43' 07” E, along said Southerly right of way line and said North line, a distance of 487.27 feet to the intersection of said right of way line and the aforementioned North right of way line of County Road 54, marked by a 5”x5” Concrete Monument with a broken top and nail in the center lying S 57°43'07” E, 0.22 feet from said intersection; thence N 89°59'32” W, along said North right of way line of County Road 54 and said South line of Lot 350, a distance of 236.52 feet to the POINT OF BEGINNING.
Containing 13,122 square feet, more or less.
You are each notified that the Petitioner filed its sworn Petition and its Declaration of Taking in this Court against you as defendants, seeking to condemn by eminent domain proceedings the above-described property located in the State of Florida, County of Pasco. You are further notified that the Petitioner will apply to the Honorable Susan Gardner Barthle, one of the Judges of this Court on the 29th day of January 2024, at 11:00 a.m., at 38053 Live Oak Avenue, Room 127, Dade City, FL 33523, for an Order of Taking Hearing in this cause - to be held in-person. All defendants to this suit may request a hearing at the time and place designated and be heard. Any defendant failing to file a request for hearing shall waive any right to object to the Order of Taking.
