NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated June 10, 2023 and an Order on Defendant's Objection to Foreclosure Sale dated October 6, 2023, entered in Civil Case No.: 19-CA-000845 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein BANK OF AMERICA, N.A., Plaintiff, and VIDAS VIGRAITIS; TUSCANY GARDENS CONDOMINIUM, INC.; KELLY RYAN BLUETT, AS PERSONAL REPRESENTATIVE OF THE ESTATE OF MARC BLUETT, DECEASED; KELLY RYAN BLUETT; THE UNKNOWN HEIRS, BENEFICIARIES, DEVISEES, GRANTEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN THE ESTATE OF MARC BLUETT, DECEASED; UNKNOWN TENANT(S) IN POSSESSION #1, are Defendants.
I will sell to the highest bidder for cash, at www.lee. realforeclose.com, at 9:00 AM, on the 8th day of November, 2023, the following described real property as set forth in said Judgment, to wit:
UNIT 203, IN BUILDING 5, OF TUSCANY GARDENS CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 04690, AT PAGE 4264, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, AND AMENDMENTS THERETO TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO, AS SET FORTH IN SAID DECLARATION.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk before the clerk reports the surplus as unclaimed. If you fail to file a timely claim you will not be entitled to any remaining funds. After the funds are reported as unclaimed, only the owner of record as of the date of the Lis Pendens may claim the surplus.
