NOTICE IS HEREBY GIVEN that on the 7th day of December, 2023, at 11:00 A.M. at, or as soon thereafter as same can be done at www.volusia.realforeclose.com, the Clerk of this Court will offer for sale to the highest bidder for cash in accordance with Section 45.031, Florida Statutes, the following real and personal property, situate and being in Volusia County, Florida to-wit:
LOT 12, BLOCK 826, DELTONA LAKES UNIT THIRTY TWO, ACCORDING TO THE MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK 27, PAGE(S) 101 THROUGH 118, INCLUSIVE, OF THE PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA
Commonly known as: 2916 Monarch Avenue, Deltona, FL 32738-2165
TOGETHER WITH
ALL OF THE RIGHTS AND BENEFITS OF THE MORTGAGOR UNDER ANY PRESENT OR FUTURE LEASES AND AGREEMENTS RELATING TO THE PROPERTY, INCLUDING, WITHOUT LIMITATION, RENTS, ISSUES AND PROFITS, OR THE USE OR OCCUPANCY THEREOF TOGETHER WITH ANY EXTENSIONS AND RENEWALS THEREOF, SPECIFICALLY EXCLUDING ALL DUTIES OR OBLIGATIONS OF THE MORTGAGOR OF ANY KIND ARISING THEREUNDER (THE “LEASES”).
The aforesaid sale will be made pursuant to the Final Judgment dated October 5, 2023, entered in Case No. 2023-11670 CIDL, now pending in the Circuit Court of the Seventh Judicial Circuit in and for Volusia County, Florida.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS.
