TO: THE STATE OF FLORIDA, THROUGH THE STATE ATTORNEY FOR THE TWELFTH TUDICIAL CIRCUIT OF THE STATE OF FLORIDA, AND TO THE TAXPAYERS, PROPERTY OWNERS, AND CITIZENS OF UNIVERSITY PARK RECREATION DISTRICT, INCLUDING NON-RESIDENTS OWNING PROPERTY OR SUBJECT TO TAXATION THEREIN, AND ALL OTHERS HAVING OR CLAIMING ANY RIGHT, TITLE OR INTEREST IN PROPERTY TO BE AFFECTED BY THE ISSUANCE OF NOT TO EXCEED $21,000,000.00 OF NON AD VALOREM ASSESSMENT BONDS OR TO BE AFFECTED IN ANY WAY THEREBY:
The above cause came before this Court upon the Complaint for Validation filed by the UNIVERSITY PARK RECREATION DISTRICT (the “District”) on February 14, 2024, seeking to determine the authority of the District to issue its not to exceed $21,000,000 UNIVERSITY PARK RECREATION DISTRICT Non-Ad Valorem Assessment Bonds, Series 2024 OF NON AD VALOREM ASSESSMENT BONDS (the “Bonds”), a more particular description of which is included in the Complaint filed in these proceedings to determine the legality of the proceedings in connection therewith, and legality of the revenues pledged for the payment thereof, including the non-ad valorem special assessments levied against the specially benefitted properties within the District and the lien created by the special assessments against the property as co-equal with the lien of state and county taxes, and seeking a final judgment of validation from this Court pursuant to Chapter 75, Florida Statutes, and said Complaint now having been presented to this Court for entry of an Order to Show Cause, and the Court being fully advised in the premises:
IT IS ORDERED AND ADJUDGED that the State of Florida and the several taxpayers, property owners and citizens of the District including nonresidents owning property subject to taxation therein, and all others having or claiming any right, title or interest in property to be affected by the issuance of the Bonds, or to be affected in any way thereby, be and are each hereby required to appear and show cause, if any there be, before the Honorable Edward Nicholas on the 29th day of April, 2024, at 11:30 a.m./p.m. in Courtroom 6E at the Manatee County Judicial Center, 1051 Manatee Avenue West, Bradenton, Florida, 34205, why the prayers of said Complaint should not be granted and why the proceedings for the Bonds, the revenues pledged for the payment thereof, the Bonds when issued pursuant thereto, and the legality of all matters in connection therewith should not be validated and confirmed as prayed in the Complaint.
AND IT IS FURTHER ORDERED AND ADJUDGED that this Order to Show Cause be published in the manner required by Section 75.06, Florida Statutes, in a newspaper of general circulation published in Manatee County, Florida.
AND IT IS FURTHER ORDERED AND ADJUDGED that, by such publication of this Order, all taxpayers, property owners and citizens of the District, including nonresidents owning property or subject to taxation therein and all others having or claiming any right, title or interest in the District, or the taxable properly therein or in any property to be affected by the issuance of the Bonds or to be affected in any way thereby, be and are made parties defendant to this proceeding, and that this Court shall have jurisdiction over them to the same extent as if named as defendants in said Complaint and personally served with process in this cause.
