NOTICE IS HEREBY GIVEN pursuant to the Final Summary Judgment of Foreclosure dated April 16, 2024 entered in Civil Case No. 2023 12437 CIDL, of the Circuit Court of the Seventh Judicial Circuit in and for Volusia County, Florida, wherein AVAIL 1 LLC is the Plaintiff, and, UNKNOWN SPOUSE, HEIRS, DEVISEE, GRANTEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHER PARTIES CLAIMING AN INTEREST BY, THROUGH, UNDER IRENE CASEY (DECEASED) OR THROUGH THE ESTATE OF IRENE CASEY; EDNA CASEY; UNKNOWN SPOUSE HEIRS DEVISEE GRANTEES ASSIGNEES LIENORS, CREDITORS, TRUSTEES AND ALL OTHER PARTIES CLAIMING AN INTEREST BY, THROUGH, UNDER YVONNE FRADET (DECEASED) OR THROUGH YVONNE FRADET; KARRIE LYN CASEY; ROBERT S. CASEY; VOLUSIA COUNTY, FLORIDA AND ALL OTHER PERSONS CLAIMING BY, THROUGH OR UNDER ANY OF THE NAMED DEFENDANT AND ANY OTHER PERSONS CLAIMING AN INTEREST IN THE REAL PROPERTY WHICH IS THE SUBJECT MATTER OF THIS ACTION BY AND THROUGH OR UNDER OR AGAINST THE NAMED DEFENDANTS HEREIN; UNKNOWN TENANT, IF ANY, are the Defendants, the Clerk of the Court, Laura E. Roth, will sell to the highest and best bidder for cash, by electronic sale at www.volusia.realforeclose.com, at 11:00 A.M. on JUNE 3, 2024, the following described property as set forth in the Final Judgment:
Lots 39, 40, 75 and 76, RYGATE, a Replat, according to the map or
plat thereof, as recorded in Map Book 27, Page 217, of the Public
Records of Volusia County, Florida.
LESS AND EXCEPT that portion conveyed in that certain Warranty
Deed recorded in Official Records Book 6085, Page 332, and being
more particularly described as follows:
A portion of Lots 75 and 76, RYGATE, a Replat, according to the map
or plat thereof, as recorded in Map Book 27, Page 217, of the Public
Records of Volusia County, Florida, described as follows:
Commence at the Northeast corner of Lot 40, of said RYGATE; thence
run South 00 degrees 59'46” East along the East line of said Lots 40
and 76, a distance of 165.11 feet to the Point of Beginning; thence
continue South 00 degrees 59'46” East, a distance of 104.50 feet to the
Southeast corner of said Lot 76; thence run North 70 degrees 08'26”
West, along the South line of said Lots 76 and 75 a distance of 199.72
feet to a point on the West line of said Lot 75; thence run North 01
degrees 04'04” West along the West line of Lot 75, a distance of 104.50
feet to a point; thence run South 70 degrees 09'13” East, a distance of
199.85 feet to the Point of Beginning.

If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk before the clerk reports the surplus as unclaimed. If you fail to file a timely claim you will not be entitled to any remaining funds. After the funds are reported as unclaimed, only the owner of record as of the date of the Lis Pendens may claim the surplus.
