NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure entered March 20, 2024 in Civil Case No. 2023 CA 003670 NC of the Circuit Court of the TWELFTH JUDICIAL CIRCUIT in and for Sarasota County, Sarasota, Florida, wherein LIBERTY SAVINGS BANK, FSB is Plaintiff and KATIMA A HALLOY, et al., are Defendants, the Clerk of Court, KAREN E. RUSHING, will sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com in accordance with Chapter 45, Florida Statutes on the 4th day of September, 2024 at 9:00 AM on the following described property as set forth in said Summary Final Judgment, to-wit:
A PORTION OF LOT 44, MYAKKA VALLEY RANCHES, UNIT NO 2, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 20, PAGES 4 AND 4A, PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, DESCRIBED AS FOLLOWS:
COMMENCE AT THE NW CORNER OF SECTION 17, TWP 37 SOUTH, RANGE 20 EAST, SARASOTA COUNTY, FLORIDA, AS SHOWN ON SAID PLAT OF MYAKKA VALLEY RANCHES, UNIT NO 2; THENCE S 00 DEGREES 29 MINUTES 46 SECONDS W, ALONG THE WEST LINE OF SAID SECTION 17, A DISTANCE OF 100 FEET TO THE NORTHWEST CORNER OF LOT 44, SAID MYAKKA VALLEY RANCHES, UNIT NO 2, FOR A P.O.B.; THENCE N 83 DEGREES 11 MINUTES 11 SECONDS E ALONG THE NORTHERLY LINE OF SAID LOT 44, A DISTANCE OF 445.81 FT TO THE NORTH-EASTERLY CORNER THEREOF, BEING A POINT ON THE CENTER LINE OF A 100 FT PRIVATE ROADWAY EASEMENT (VANDERIPE ROAD); THENCE SOUTHEASTERLY ALONG SAID CENTERLINE, AND NORTHEASTERLY LINE OF LOT 44, AND ALONG THE ARC OF A CURVE, CONCAVE TO THE NORTHEAST, HAVING A RADIUS OF 358.10 FT THROUGH A CENTRAL ANGLE OF 45 DEGREES 18 MINUTES AND 08 SECONDS, A DISTANCE OF 283.14 FT; THENCE S 37 DEGREES 53 MINUTES AND 03 SECONDS W, 50 FT TO A POINT ON THE SOUTHWESTERLY R/W LINE OF SAID 100 FT PRIVATE ROAD EASEMENT; THENCE SOUTH 51 DEGREES 42 MINUTES 08 SECONDS W 218.57 FT TO A CONCRETE MONUMENT; THENCE S 37 DEGREES 33 MINUTES 39 SECONDS W, 629.17 FT TO A CONCRETE MONUMENT ON THE WEST LINE OF SAID LOT 44, SAID POINT LYING N 00 DEGREES 29 MINUTES 46 SECONDS E OF, AND 182.0 FT FROM THE S.W. CORNER OF SAID LOT 44; THENCE N 00 DEGREES 29 MINUTES 46 SECONDS E, ALONG SAID WEST LINE OF LOT 44, 860.96 FEET TO THE POINT OF BEGINNING.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens, must file a claim before the clerk reports the surplus as unclaimed.
