YOU ARE NOTIFIED that a Petition for Termination proceeding hereinafter described is pending in the Circuit Court, Twelfth Judicial Circuit in and for Manatee County, Florida, the style of which is: IN RE: The Termination of Parental Rights for the Proposed Adoption of Infant Hertzog (DOB: 3/7/24)
You are required to serve a copy of your written response, if any, to it on W. SCOTT HAMILTON, ESQUIRE, Petitioners' attorney, whose address is 2400 Manatee Avenue West, Bradenton, Florida, 34205, on or before JUNE 5, 2024, and file the original with the Clerk of the Court at Manatee County Clerk of Court, PO Box 25400, Bradenton, Florida 34206 either before service on Petitioners' attorney or immediately thereafter, otherwise a default will be entered against you for the relief demanded in the Petition.
The identity of the birth father: Hispanic or Black male, age unknown, present whereabouts are unknown.
Pursuant to the Petition, the child was born at Manatee Memorial Hospital, Bradenton, Florida. The Indian Child Welfare Act is not applicable to this child. There are no known grandparents with rights to notice of this proceeding. The grounds for termination of parental rights are those set forth in Section 63.089 of the Florida Statutes.
There will be a hearing on the Petition for Termination of Parental Rights on July 15, 2024 at 10:30AM before the Honorable Charles Sniffen at the Manatee County Judicial Center, 1051 Manatee Ave. West, Courtroom 3E, Bradenton, Florida 34205.
If you execute a Consent to Adoption or an Affidavit of Non-paternity and a Waiver of Venue, you may have the right to request that the hearing on the petition to terminate parental rights be transferred to the county in which you reside. You may object by appearing at the hearing or filing a written objection with the Court.
If you elect to file written defenses to said Petition, you are required to serve a copy on Petitioner's attorney, W. Scott Hamilton, Esquire, Hamilton, Price & Marshall, PA, 2400 Manatee Avenue West, Bradenton, FL 34205 (941)748-0550, and file the original response or pleading in the Manatee County Clerk's Office, PO Box 25400 Bradenton, Florida 34206.
UNDER SECTION 63.089, FLORIDA STATUTES FAILURE TO FILE A WRITTEN RESPONSE TO THIS NOTICE WITH THE COURT OR TO APPEAR AT THIS HEARING CONSTITUTES GROUNDS UPON WHICH THE COURT SHALL END ANY PARENTAL RIGHTS YOU MAY HAVE REGARDING THE MINOR CHILD.
