TO: THE UNKNOWN BENEFICIARIES, TRUSTEES, DEVISEES, ASSIGNEES, LIENORS, CREDITORS, AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN THE RUSSEL C. ECKERT, SR. AND VERA A. ECKERT TRUST U/T/A DATED NOVEMBER 5, 1991.
Whose residence is unknown if he/she/they be living; and if he/she/they be dead, the unknown defendants who may be spouses, heirs, devisees, grantees, assignees, lienors, creditors, trustees, and all parties claiming an interest by, through, under or against, the Defendants, who are not known to be dead or alive, and all parties having or claiming to have any right, title or interest in the property of the trust.
YOU ARE HEREBY NOTIFIED that an action to establish the lost trust and its administration of the Russel C. Eckert, Sr. and Vera A. Eckert Trust u/t/a/ Dated November 5, 1991, in the Circuit Court for Lee County, Florida, Civil Division, the address of which is 1700 Monroe Street, Fort Myers, Florida 33901, Case No. 24-CA-6750 has been filed.
This matter includes the determination of trustees and beneficiaries, declaratory judgment establishing existence of trust, and a quiet title action has been filed against you and you are required to serve a copy of your written defenses, if any, to it on counsel for Plaintiffs whose address is 9990 Coconut Road, Suite 210, Bonita Springs, Florida 34135, on or before December 16, 2024 and file the original with the clerk of this circuit court either before service on Plaintiffs' Attorney or immediately thereafter; otherwise, failure to take timely action may result in a default judgment entered against you for the relief demanded in the complaint herein.
