NOTICE OF RULEMAKING BY
THE HARBOR BAY COMMUNITY DEVELOPMENT DISTRICT
In accordance with Chapters 190 and 120, Florida Statutes, the Harbor Bay Community Development District (“District”) hereby gives notice of intent to develop, amend and adopt rules and rates related to the use and enforcement of use of the District's access and entry gates and costs incurred by the District arising from gate strikes and damage to gates caused by users. A public hearing will be conducted by the Board of Supervisors of the Harbor Bay Community Development District on March 20, 2025 at 6:00 p.m. at the MiraBay Clubhouse located at 107 Manns Harbor Drive, Apollo Beach, Florida 33572. The public hearing will provide an opportunity for the public to address the proposed rules and rates. A copy of the proposed rules and rates may be obtained by contacting the District Manager at (813) 344-4844. The proposed rules and rates may be amended at the public hearing by the Board following public comment and Board discussion.
The purpose and effect of the rules and rates is to provide for efficient and effective District operations and enforcement, as provided by Section 190.035, particularly in connection with the District's entry and access gates and costs incurred due to gate strikes and gate damage. Specific legal authority for the rules includes Sections 190.011(5), 190.011(15), 190.012(3), 190.035, 120.54, and 120.81(2), Florida Statutes. Prior Notice of Rule Development was published in the Tampa Bay Times on February 7, 2025.
A request for a public hearing by any affected person on the District's intent to adopt its proposed rules and rates must be made in writing to the District Manager, 4530 Eagle Falls Place, Tampa, Florida 33619, and must be received within twenty-one (21) days after the date of this notice.
The public hearing may be continued to a date, time, and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at the public hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which such appeal is to be based. At the hearing, staff or Supervisors may participate in the public hearing by speaker telephone.
