NOTICE OF PROPOSED AGENCY ACTION
IMPLEMENTATION OF INSTITUTIONAL CONTROL
The Hillsborough County Environmental Protection Commission (EPC) gives notice that it intends to approve the implementation of an Institutional Control (IC) prior to issuance of a Site Rehabilitation Completion Order with Conditions (CSRCO) for a contaminated site. 1607 Property Inc. is seeking implementation of this IC in reference to DEP Site ID # ERIC_3871, the Former Pitch Pine Lumber (FPPL) site, 1607 North 43rd Street, Tampa, Florida (Site), and intends to restrict exposure to contamination by relying on local permitting to restrict use of groundwater in the vicinity of the Site as depicted below.
The Florida Department of Environmental Protection (DEP) and the EPC have implemented a procedure in which an electronic record system is shared with the Southwest Florida Water Management District (SWFWMD), which will document the location and extent of the groundwater contamination. SWFWMD will use this information when reviewing a well permit application and may require additional information regarding well construction and location, as well as additional information from DEP regarding the extent and type of contamination prior to issuing a well construction permit in the affected area. This additional permitting information will ensure that contaminated groundwater is identified and well construction is managed appropriately to prevent contamination exposure to humans and the environment.

Local governments with jurisdiction over the property subject to the Institutional Control, real property owner(s) of any property subject to the IC, tenants, residents of any property subject to the Institutional Control and any party holding a materially affected encumbrance in the area subject to the control have 30 days from publication of this notice to provide comments to the EPC.
