NOTICE OF ISSUANCE OF
APPROVAL OF SOIL MANAGEMENT/REMEDIAL ACTION PLAN
The Florida Department of Environmental Protection (FDEP) gives notice of the issuance of a Soil Management (SMP)/Remedial Action Plan (RAP) Approval Order (Order) for cleanup of the contaminated site known as Vigoro Industries (Former) - a/k/a US Fertilizer Site, 2121 Third St SW, Winter Haven, Polk County, Florida, FDEP Facility ID BF531001001, ERIC_13345, OGC No. 88-0899 (the Property). The Order confirms that the FDEP has approved a SMP/RAP for a portion of the site consisting of the Property, and that the SMP/RAP meets the requirements of Chapter 62-780, FAC, for site rehabilitation.
The files associated with the Order is available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays at FDEP, 13051 N. Telecom Parkway, Suite #101, Temple Terrace, FL 33637, attention: John R. Sego, P.G., [email protected] or online at http://depedms.dep.state.fl.us/Oculus/servlet/login, Facility identification: ERIC_13345.
A person whose substantial interests are affected by the Department's action may petition for an administrative proceeding (hearing) in accordance with Sections 120.569 and 120.57, FS. The petition must be received by the Agency Clerk, Department of Environmental Protection, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at [email protected] within 21 days of the publication of this notice.
The failure of any person to file a petition for an administrative hearing within the appropriate time period shall constitute a waiver of that person's right to request an administrative determination (hearing) under Sections 120.569 and 120.57, FS.
