NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Mortgage Foreclosure dated November 13, 2025 entered in Civil Case No. 24-CA-004205 of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein BANK OF AMERICA, N.A. is Plaintiff and EUGENE M HERGENROTHER TRUSTEE OF THE EUGENE O HERGENROTHER REVOCABLE TRUST 2001, KURT M HERGENROTHER, EUGENE M HERGENROTHER A/K/A MARTY HERGENROTHER and BETTY GANO, et al, are Defendants. The Clerk, KEVIN C. KARNES, shall sell to
the highest and best bidder for cash at LEE County On-Line Public Auction website: https://lee.realforeclose.com, at 09:00 AM on December 18, 2025, in accordance with Chapter 45, Florida Statutes, the following described property located in LEE County, Florida, as set forth in said Final Judgment of Mortgage Foreclosure to-wit:
UNIT 105, CASA BELLA CONDOMINIUM, PHASE VII, BLDG 7, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 1432, PAGE(S) 848, ET SEQ., OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA; AND ANY AMENDMENTS THERETO; TOGETHER WITH AN UNDIVIDED INTEREST IN AND TO THOSE COMMON ELEMENTS APPURTENANT TO SAID UNIT IN ACCORDANCE WITH AND SUBJECT TO THE COVENANTS, CONDITIONS, RESTRICTIONS, TERMS AND OTHER PROVISIONS OF THAT DECLARATION OF CONDOMINIUM.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim before the clerk reports the surplus as unclaimed. The court, in its discretion, may enlarge the time of the sale. Notice of the changed time of sale shall be published as provided herein.
