As the owner of a 2021 42’ Freeman Boatworks LR, HULL ID# IGG42091J021 (the “vessel”)-and pursuant to 46 U.S.C § 30501, et seq., and Supplemental Rule F of the Federal Rules of Civil Procedure TRICIA A. SPIVEY, individually and as the personal representative of the estate of Randall L. Spivey, Jr., filed a complaint on July 2, 2026, in the United States District Court for the Middle District of Florida seeking exoneration from, or
limitation of, any liability concerning any and all personal injury, property damage, destruction, or other losses arising out of or related to a December 19, 2025 incident on the navigable waters in the Gulf of America over 75 miles southwest of Marco Island, Florida, involving Randall L. Spivey, Jr. and Brandon Billmaier, who departed for an offshore fishing trip on the vessel, but never returned home, and are presumed to have died at sea, as more fully described in the complaint. The court has accepted a letter of undertaking as interim security for all claims against the Plaintiff and the vessel. Pursuant to 46 U.S.C. § 30511(c), “all claims and proceedings against the owner related to the matter in question shall cease.”
By September 10, 2026, all persons or entities claiming damage for any and all loss, destruction, injuries, and/or death allegedly as a result of the occurrences and happenings recited in the complaint must file their respective claims with the clerk of this court and serve copies thereof on Plaintiff counsel. By the same date, all persons or entities presenting claims and desiring to contest the allegations of the complaint must file an answer to the complaint in this court and must serve copies thereof on Plaintiff counsel or be defaulted. Service on Plaintiff counsel may be made by delivery or mail to Richard J. McAlpin, or Christopher A.
