PARCEL 1: AN ABSOLUTE AND INDEFEASIBLE FEE SIMPLE TITLE IN AND TO AN UNDIVIDED ONE-SIXTY-THIRD (1/63) INTEREST IN AND TO THAT CERTAIN PARCEL OR PARCELS OF LAND DESIGNATED AS LOT A, AS EXEMPLIFIED, REFERRED TO AND SET FORTH IN THE SURVEY WHICH IS AN EXHIBIT TO THE DECLARATION OF RESTRICTIONS, RESERVATIONS, COVENANTS, CONDITIONS AND EASEMENTS, RECORDED IN OFFICIAL RECORDS BOOK 848, AT PAGE 536, OF THE PUBLIC RECORDS OF POLK COUNTY, FLORIDA, TOGETHER WITH ALL BUILDINGS, IMPROVEMENTS AND APPURTENANCES THEREON LOCATED.
PARCEL II: AN ABSOLUTE AND INDEFEASIBLE FEE SIMPLE TITLE IN AND TO ALL OF APARTMENT UNIT 24, BEING SITUATED ON THE 2ND FLOOR OF BERKELEY HOUSE, WINTER HAVEN HARBOUR APARTMENTS, ACCORDING TO THE FLOOR PLAN WHICH IS A PART OF THE PLOT PLANS AND SURVEY WHICH ARE AN EXHIBIT TO THE DECLARATION OF RESTRICTIONS, RESERVATIONS, COVENANTS, CONDITIONS AND EASEMENTS RECORDED IN OFFICIAL RECORDS BOOK 848, AT PAGE 536, OF THE PUBLIC RECORDS OF POLK COUNTY, FLORIDA. SAID APARTMENT UNIT 24, OF BERKELEY HOUSE CONSTITUTES ALL OF THE SPACE OR AREA LOCATED WITHIN THE PERIMETER OF THE UNFINISHED AND UNDECORATED WALLS, FLOORS AND CEILINGS OF SAID APARTMENT UNIT 24 OF BERKELEY HOUSE AS SHOWN AND SET OUT IN SAID DECLARATION AND EXHIBIT THERETO.
PARCEL III: A PERPETUAL AND NON-EXCLUSIVE EASEMENT IN COMMON WITH, BUT NOT LIMITED TO, ALL OTHER OWNERS OF UNDIVIDED INTERESTS IN THE LAND AND IMPROVEMENTS DESCRIBED ABOVE IN PARCEL I, FOR EGRESS AND INGRESS AND WITH ALL OF THE PUBLIC PASSAGEWAYS, COMMON AREAS AND FACILITIES UPON THE LAND DESCRIBED IN PARCEL I, AND MORE PARTICULARLY DESCRIBED AND IDENTIFIED IN THE AFORESAID RECORDED DECLARATION OF RESTRICTIONS, RESERVATIONS, COVENANTS, CONDITIONS AND EASEMENTS, RECORDED IN OFFICIAL RECORDS BOOK 848, AT PAGE 536, OF THE PUBLIC RECORDS OF POLK COUNTY, FLORIDA, TOGETHER WITH ALL THE RIGHTS, POWERS AND PRIVILEGES INURING TO THE BENEFIT OF ALL OWNERS OF UNDIVIDED INTERESTS IN THE LAND AND IMPROVEMENTS DESCRIBED IN PARCEL I ABOVE.
has been filed against you and you are required to serve a copy of your written defenses, if any, to it on Orlando F. Amador, Esquire, Brock & Scott, PLLC., the Plaintiff’s attorney, whose address is 4919 Memorial Hwy, Suite 135, Tampa, FL 33634, within thirty (30) days of the first date of publication on or before April 8th, 2026, and file the original with the Clerk of this Court either before service on the Plaintiff’s attorney or immediately thereafter; otherwise a default will be entered against you for the relief demanded in the complaint or petition.
