NOTICE IS HEREBY GIVEN that I, the undersigned Clerk of the Circuit Court of Charlotte County, Florida, shall sell the property at public sale to the highest bidder for cash, except as set forth hereinafter, on October 29, 2026 at 11:00 a.m. at www.charlotte.realforeclose.com, in accordance with Chapter 45 Florida Statutes, the following-described real property:
Parcel 1:
Lot 15, Block 14, PRAIRE CREEK PARK SUBDIVISION, a Subdivision, according to the plat thereof, as recorded in Plat Book 13, Pages 33A through 33S, of the Public Records of Charlotte County, Florida.
LESS & EXCEPT
A tract or parcel of land being part of Lot 15, Block B-14, of PRAIRE CREEK SUBDIVISION, as recorded in Plat Book 13, Page 33, of the Public Records of Charlotte County, Florida, as described as follows:
From the Point of Beginning, being the Northwest corner of said Lot 15; thence North 88° 46’ 25” East for 670.74 feet along the Northerly line of said Lot 15; thence South 00° 33’ 20” West for 649.82 feet along the Easterly line of said Lot 15; thence South 88° 45’ 06” for 675.14 feet; thence North 00° 56’ 31” East for 650.23 feet along the Westerly line of said Lot 15 for the Point of Beginning.
Subject to and together with an ingress-egress easement being the Easterly 40.00 feet of the Southerly 270.00 feet of the above-described parcel.
The said sale will be made pursuant to the Final Judgment of Foreclosure of the County Court of Charlotte County, Florida, in Civil Action No. 26000595CC, Prairie Creek Park Property Owners Association, Inc., Plaintiff vs. Mark P. Malay and Marina V. Malay, Defendants.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
